Terms & Conditions of Sale

Article 1 - Seller identification

These Terms and Conditions of Sale (the “Terms”) govern all sales made through the website gda6.art (the “Website”), operated by the independent art project Ghost Data Archive · GDA6 (the “Seller”).

Article 2 - Purpose and scope

These Terms apply to all sales of products offered on the Website - namely the three (3) numbered collectible disc editions of the GDA6 · Ghost Data Archive series (together, the “Products”):

• PRINT / BOOTLEG - edition of 66,666 numbered pieces;
• GOLD MASTER - edition of 6,666 numbered pieces;
• PLATINUM / ENGRAVED - edition of 666 numbered pieces.

By placing an order, the customer (the “Customer”) fully and unreservedly accepts these Terms in their version in force at the date the order is placed.

Article 3 - Products

3.1 - Description

Products are collectible discs, sized to fit a standard game case. Each disc is individually numbered within its edition and presented as an archive entry of the GDA6 · Ghost Data Archive series. The three editions share the same object and differ by finish and treatment (standard print; gold finish; premium engraving). Minor colour and finish variations between the on-screen artwork and the delivered product may occur due to display settings and the manufacturing process, and are inherent to collector objects.

3.2 - Independent art project

The Products are an original, independent art edition. They are not affiliated with, endorsed by, sponsored by, or connected to any game title, studio, publisher, or platform holder. All artwork, artist identities, and music are original and fictional, offered as artistic commentary and homage.

3.3 - Limited editions

Each edition is a limited, numbered run of the size stated in Article 2. Once an edition is sold out, no further units will be produced and sold-out Products cannot be back-ordered.

3.4 - Content and packaging

The Products are decorative collector's items. They contain no data, are not playable, and do not contain any video game, game code, or game data. They are not a game and are not a substitute for any game or software.

The GDA6 soundtrack (the “recovered score”) is an original musical work made available separately by streaming; it is not sold or delivered as playable data on the disc. To access the music, the Customer uses the streaming links provided on the Website.

Packaging varies by edition (protective sleeve, pouch, or box); the PLATINUM / ENGRAVED edition includes a display base. The disc is designed to slip into an empty standard game case or to be displayed as a collector's piece.

Article 4 - Prices

Prices are displayed in US dollars (USD), inclusive of any applicable taxes, excluding shipping. The current prices are: PRINT / BOOTLEG - $6, GOLD MASTER - $66, PLATINUM / ENGRAVED - $666. Shipping charges are shown before final validation of the order. The Seller reserves the right to modify its prices at any time; Products are invoiced at the price in effect at the moment the order is confirmed.

Article 5 - Orders

5.1 - Placing an order

The Customer selects the desired Product(s), adds them to the cart, and completes payment. A confirmation email summarising the order is then sent to the address provided at checkout; this email constitutes acceptance of the order by the Seller.

5.2 - Modifications and cancellations

Because each disc is produced to order as part of a limited numbered edition, no modifications or cancellations can be accepted once the order has been submitted to production, except as required by applicable law (see Article 8).

Article 6 - Payment

Payment is made online at the time of order validation through the payment methods available on the Website (secured by our payment provider, Stripe). The Seller does not store any of the Customer's banking data. The order is validated upon full payment of the Product price and shipping charges.

Article 7 - Delivery

7.1 - Shipping guarantee

Every disc will be shipped no later than November 1, 2026 - a full 18 days before the anticipated release of the game on November 19, 2026. Orders placed after that date will be shipped within a reasonable production window and tracked individually.

7.2 - Pre-order & delivery times

All orders are pre-orders. Discs are produced in limited numbered runs and may therefore be dispatched at any moment during the production window - however every order placed before the cut-off is guaranteed to be shipped no later than November 1, 2026, ahead of the game's release. The Customer will be notified by email as soon as their parcel leaves our facility, with a tracking number attached.

The Seller delivers worldwide to the countries listed at checkout. Indicative shipping times after dispatch are 3 to 12 business days within Europe and up to 20 business days for other international destinations. These lead times are provided for information only and do not constitute a contractual commitment. The Seller cannot be held liable for delays attributable to the carrier or events of force majeure. Any customs duties or import taxes for international destinations are the responsibility of the Customer.

7.3 - Order tracking

A tracking number is sent to the Customer by email as soon as the parcel is dispatched.

7.4 - Receipt of goods

The Customer must check the condition of the parcel upon receipt. In the event of damage, the Customer must file a complaint with the carrier and notify the Seller within 48 hours of receipt, with photographs of the damaged parcel and Product.

Article 8 - Right of withdrawal (pre-orders)

Because every Product on the Website is sold as a pre-order from a limited numbered edition, the Customer may cancel their order free of charge at any time before the Product has been dispatched. A cancellation request sent by email to contact@gda6.com before shipment triggers a full refund within fourteen (14) days, using the original payment method.

Once the Product has been dispatched, and in accordance with applicable consumer law, the Customer still benefits from a legal period of fourteen (14) calendar days from receipt of the Product to exercise their right of withdrawal without justification. To do so, the Customer notifies the Seller by email at contact@gda6.com, stating the order number. The Product must be returned in its original condition and packaging within 14 days of notification. Return shipping costs are borne by the Customer. Refunds are processed within fourteen (14) days of receipt of the returned Product using the original payment method.

Article 9 - Legal warranties

The Seller is required to deliver a Product that conforms to the order and benefits from the legal warranties provided by applicable law. In the event of a manifest manufacturing, pressing, printing or engraving defect, the Customer is invited to contact the Seller within 30 days of receipt with photographs. After verification, the Seller will offer a replacement or a refund.

Article 10 - Liability

The Seller's liability shall not be engaged in the event of:

• Misuse or improper care of the Product by the Customer;
• Force majeure or an unforeseeable event caused by a third party;
• Delivery delays or failures attributable to the carrier;
• Temporary unavailability of the Website.

The Seller's liability is limited to the amount of the order concerned. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including the Customer's statutory consumer rights.

Article 11 - Intellectual property

All elements of the Website and of the Products (texts, artwork, logos, illustrations, music, artist identities) are original creations of the Seller and are protected by applicable intellectual property laws. Any reproduction, distribution, or commercial exploitation without prior written authorisation is strictly prohibited.

Article 12 - Personal data & privacy

The processing of personal data collected during ordering is described in the Seller's Privacy Policy.

Article 14 - Governing law and jurisdiction

These Terms are governed by French law. In the event of a dispute, the parties shall first seek an amicable resolution. Failing that, the dispute shall be submitted to the competent courts, subject to the mandatory provisions of consumer law in favour of the consumer. EU consumers may also use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

Article 15 - Miscellaneous

If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect.
